PAYMENT

IS ONLINE PAYMENT SECURE?
THE ART DESIGN LAB is committed to using encrypted and secure methods of transmission and payments among the most efficient of current technology. No information about your payment is kept.
WHAT HAPPENS IF MY PAYMENT IS REFUSED?
A request for banking authorization is made to your bank when you place your order online. In order to proceed to the payment, you will be asked to provide your credit card number, the expiry date of the card and a three-digit visual cryptogram on the back of your card. In case of refusal by your bank, the order will unfortunately not succeed and you will have to reorder and make your payment with another credit card. Do not hesitate to call us, we will give you our advice and solutions.
IS IT POSSIBLE TO PAY IN INSTALLMENTS?

DELIVERY
WHAT ARE THE DELIVERY METHODS, DEADLINES AND PRICES?
The rates are as follows:
PRIVILEGED STATUS (order over 3.000 €): free delivery, Paris and International.
INITIATED STATUS (order over 1.000 €): express delivery offered in Paris. For any other destination, you will find below the prices.
INVITED STATUS (order less than 1.000 €), you will find below the prices.

For deliveries outside the European Union, we make every effort to facilitate customs clearance with our delivery service provider, so as not to delay delivery. In some cases, however, the delivery time may be extended due to customs controls, which are beyond our control.
The delivery time announced when taking the order is calculated according to the destination city, according to the transport plan of our delivery partner, in order to tell you a reliable delivery time.
The amount of customs duties and taxes is not included in the selling price and delivery cost.
Your telephone number will be transmitted to our carrier to facilitate the delivery of your order. Shipping confirmation and tracking text messages will be sent to you. Verification of contact information with the buyer’s credit card issuer may be required prior to shipping your order. In this case, THE ART DESIGN LAB undertakes to do everything possible not to delay the shipment.
CUSTOMS DUTIES AND TAXES
The amount of customs duties and taxes is not included in the selling price and delivery cost.
Prices are displayed “Excluding any customs charges”. Any parcel coming from a foreign country must be cleared through customs: additional taxes and customs duties may apply and must be paid to the local authorities.
To find out the tax applicable to imported pieces of art, you are invited to contact the competent customs authorities.
As a guide, you will find below some information on the subject. For more information, the TARIC (Taxation and Customs Union) database can be consulted.
• Shipping from the European Union to the European Union: no customs duties as we benefit from a common customs territory.
• Shipment from the European Union to a third country (outside the European Union): consult the customs authorities of the third country.
• For your information:
Shipment from the European Union to the United States: no customs duties on original works of art created by living artists,
Shipment from the European Union to Russia: no customs duties on original works of art created by living artists,
Shipment from the European Union to China: as it stands at present, the information provided by the competent authorities is 6% customs duty.
WHO CAN ACCEPT MY ORDER? CAN I HAVE IT DELIVERED TO MY WORKPLACE? WHAT HAPPENS IF I AM NOT THERE AT THE TIME OF DELIVERY? HOW DO I TRACK MY ORDER? CAN I CHANGE THE PLACE OF DELIVERY OF MY ORDER?
Anyone present at the exact address indicated on the order can receive your parcel against signature. No delivery to an address other than the one indicated on the delivery label will be made (neighbour or relay point) without your prior agreement.
The change of delivery address after validation of your order is not possible, unless you have requested it beforehand from our customer service or by connecting yourself on the link that our transport partner (DHL) will have sent you by text message to notify you of the delivery in progress.
DELIVERY INFORMATION
The transport partner (DHL) will systematically send you a text message as soon as the parcel leaves THE ART DESIGN LAB, to confirm the day and time of delivery. The morning of the delivery (express delivery), you will receive a second text message to inform you of the imminent delivery of the order.
IN CASE OF ABSENCE
In case of planned absence before delivery, a delivery can be rescheduled (Monday to Friday).
1 By logging on to our carrier partner’s website (indicated on the text message sent by the carrier at the time of shipment) or by clicking on the following link: http://ondemand.dhl.com.
2 By indicating the air waybill number of the package (communicated in the text message).
3 A new delivery date may be chosen. In case of absence at the time of delivery, a delivery notice will be placed in your mailbox. By default, the new delivery will be scheduled the next day of the attempt, between 9am and 6pm (local time). An additional presentation can be scheduled for free.
ORDER TRACKING
The progress of the preparation and delivery of the order can be viewed by logging into the “My orders” page of your account.
MODIFICATION OR CANCELLATION OF THE ORDER
For any modification of the delivery address or cancellation of the order, you can go to the “Contact us” section. If the order is still in preparation, THE ART DESIGN LAB will try to accommodate your request. In case of possible cancellation, your bank account will not be debited.
RETURN AND EXCHANGE/REFUND POLICY
If the piece of work does not correspond to your wishes, you must go to the “Contact us” section within 14 days of its reception. The piece of work must be returned in its original packaging (box, protective accessories, label, certificate of authenticity…) accompanied by the *return voucher duly completed and sent to you by email. Upon receipt of the piece of work and after verification and validation by our services, the customer will be refunded.
Return shipping is free. In Paris, you can go to the “Contact” section and THE ART DESIGN LAB will pick up the goods at your address.
For returns from countries of the European Union and outside the European Union:
1 The piece of work to be returned must be repackaged in its box and its original cardboard box, the return transport label* must be stuck on the parcel on the outward transport label.
2 You will need to go to “Contact Us” to arrange a pick-up date at the location of your choice.
3 Our delivery partner will contact you to confirm the day of collection.
4 Our delivery partner will show up on the day agreed with you and collect the parcel.
For returns from countries outside the European Union, DOM-TOM
1 You will need to select the piece of work to be returned by logging into the “My Orders” page of your account.
2 A return label and customs documents will be sent by email within 48 hours.
3 You will have to go to the “Contact us” section to organize with THE ART DESIGN LAB the day and place of collection of its piece of work.
4 The piece of work to be returned must be repackaged in its original box and cardboard box, the return transport label* must be stuck on the package on the outward transport label.
5 Our delivery partner will contact you within 24 hours to plan the collection of your parcel.
The time taken to validate a return to our gallery is two working days, before triggering the refund request.
You will be notified by email of the refund issued and the mention “Refunded” will appear in front of the product refunded, under the heading “My orders”. You will be refunded the total amount of the artwork on the original credit card of the purchase, except for the cost of delivery and taxes. Reimbursement can only be requested by the person who placed the order and will be made on the original means of payment. It can be processed within 15 working days by the customer’s bank. This delay varies according to the card issuer and we are not in a position to influence this delay.
CAN I CHANGE A PIECE OF WORK I RECEIVED AS A GIFT?
To return an unwanted gift and make an exchange, the recipient is invited to go to the “contact” section. THE ART DESIGN LAB will accompany the recipient in the selection of the piece of work to be replaced. The amount of the chosen piece of work must correspond to the amount of the previously ordered one. No refund can be made to the recipient of the gift.
WHAT TAX BENEFITS CAN I GET?
• Acquisition of pieces of work by living artists by businesses and professionals
• Article 238bis AB of the CGI states that: “Companies acquiring pieces of work by living artists may deduct from the result of the acquisition exercise and the following four years, in equal parts, an amount equivalent to the purchase price of the artwork. This mechanism thus makes it possible to reduce, each year, for 5 years, 20% of the purchase price of artworks by living artists.
This tax advantage is subject to the following conditions:
Acquired works must be registered in a fixed assets account.
The deduction for each financial year must not exceed 0,5 % of the turnover for the year.
• The work must be displayed during the 5 years, in a place made available to employees and visitors of the company.
• The company must record in a special reserve account on the liabilities side of the balance sheet an amount equal to the deduction made, knowing that this amount will be reintegrated into taxable income in the event of changes in the use or transfer of the artwork or deductions from the reserve account.
For individuals
• Solidarity Tax on Fortune exemption
• Article 885I of the CGI states that: “Artworks are not subject to the Solidarity Tax on Fortune. They are not included in the STF return and the amounts spent on the acquisition are not subject to tax. This tax provision applies to paintings, drawings, gouaches, watercolours as well as sculptures and bronzes.”
• Taxation and advantage of capital gains:
• Article 271 of the CGI states that: “in the event of resale of a work of art, the seller, if he has an invoice, can choose two options. The flat-rate tax of 5% or the application of the general capital gains regime (same system as for real estate capital gains with exemption after 15 years). If he does not have an invoice, the seller must pay the 5% tax which will be paid by the sales agent on behalf of the seller. With regard to the transfer of assets: under certain conditions, artworks may be included in the 5% fixed price of furnishings in the event of succession “.
CERTIFICATE OF AUTHENTICITY
WHEN WILL THE CERTIFICATE OF AUTHENTICITY BE SENT TO ME?
The certificate of authenticity will be sent to you, with the artwork you have chosen, in a box.
IS IT POSSIBLE TO OBTAIN A DUPLICATE CERTIFICATE OF AUTHENTICITY?
On simple request in the heading “Contact”, we will send you a duplicate certificate of authenticity of the artwork you ordered.
